The District Attorney moved forward with a 2009 election investigation after a previous 2008 probe into the mayor and another councilman stalled due to manpower limitations. Although Russell Grant and Charles Roaches initially reached a plea deal involving Grant's resignation and probation, the District Attorney took the case to a grand jury last month. Both men were indicted after failing to follow the terms of their probation process.

Michael Allison rejected a probation plea deal from State's Attorney Tom Wiseman, choosing instead to challenge the constitutionality of the Illinois eavesdropping law. Represented by the ACLU, Allison argues the statute violates seven amendments of the U.S. Constitution, including free speech and due process. He maintains that fighting the case is necessary to preserve civil liberties and ensure the right to hold public officials accountable.

Defense attorneys reportedly made a deal with prosecutors to allow a self-defense plea in exchange for including voluntary manslaughter charges, allegedly without consulting the Davidian defendants. The jury was later given nearly 90 pages of complex instructions regarding the third count of possessing a firearm during a violent crime. This legal maneuvering resulted in a confusing verdict where defendants were acquitted of murder but convicted on weapons charges.
