For those who do, yes send the constable out there if the parent signs on the dotted line It also relinquishes the county of potential lawsuits surrounding this program because there will be lawsuits if it continues 450 visits a night and there's bound to be problems We've seen in the news here recently about one constable that has been accused of raping a young girl I mean this would be a prime opportunity for something like this to take place. How can you do this? Other suggestions of the program, here's what you can do. You can call your county constables. Call them and let them know how you feel. What is even better than that is write them a letter. Write them a letter and say I don't like the way your implementing the ASAP program follow state law or make it voluntary or both

He's recognized that there are flaws all over the place with the statistics, that it doesn't make sense to spend $600,000 of the county's money and $275,000 of Austin Independent School District money to implement a program in this type. It doesn't need to be county constables coming into your house. pay new school attendance clerks with that money, far less money to come in and make these phone calls. We can have personal computers with programs that automatically dial these telephone numbers and leave a pre-recorded message asking the parent or guardian or whoever's in charge of that child to call the school that hey your child was absent from school this day there are so many alternatives this program and I want to leave you with just one last thought

When you continue to read the contents of the bill it goes on to say basically in subsection 3 here

Paramilitary organization means a group of three or more persons organized on a military pattern who possess firearms or explosive weapons So essentially what that's saying folks, if you are in a group over at somebody's house and there is three or more of you there and you happen to possess a firearm according to this new bill that took effect. You are breaking the corporate de facto laws

Or meets with two or more persons at paramilitary organizations to train with practice or be instructed in the use of a firearm

Want to welcome you this evening we're going to be talking about the ASAP program for those of you who don't know The ASAP program is short for the Absent Students Assistance Project It's a program here in Travis County where Travis County constables have been hired through an interlocal agreement from Austin Independent School District and Dell Valley at least for the Dell Valley ninth graders To handle school attendance problems

2:46:44 That in and of itself is not a violation of Texas state law, but as we have demonstrated so many times before the way that the program is implemented is a clear violation of Texas state law and your constitutionally protected rights. The program works like this if your child is absent from school in such a way that it may be an unexcused absence or at least appear to be an unexcused absence, the school sends out a county constable to your house between the hours of 6.30pm and 9.30pm at night." Now these visits that are made between 6.30am and 9.30pm at night using their own documentation

This is a person we're standing in front of the home of a person who was violated by this program As you can see, the house is surrounded on all sides by six-foot chain link fence. As you noticed from the tape earlier there are signs all over the chain link fence clearly indicating no trespassing Now, the United States Supreme Court has upheld the notion that it is a violation of law to go onto another person's property without their permission. This law has been upheld to apply to law enforcement officials as well. The only way they can come on your property without your permission if there aren't clearly marked no trespassing signs if they're in sort of a common area If they have summons or some other lawful process

That would allow them to come onto your property without your permission however in particular When dealing with school attendance, the Texas legislature felt like they had to specifically protect your property and protect your privacy. So they wrote into the education code which I'll read you here this is section 25.091 letter B A school attendance officer may not enter a private residence or any part of the private residence without the permission of the owner or tenant except to serve lawful process on a parent, guardian, or other person standing in parental relation to a child to whom the compulsory school attendance law applies.

2:49:10 Now, it appears to me from looking at this that the Texas legislature which by the way this education code was revisited by the 74th legislature a couple of years ago and if there was ever time to rewrite the code in such a way to allow law enforcement officials to come on your property without your permission in an effort to so-called communicate which we've proven that's not the purpose of the program as its been stated but the fact is If there was ever a time that they wanted to write into the state education code that it was alright to do that, that would have been the time to do it. They didn't do that in fact as I've just demonstrated you they did quite the opposite The Texas legislature made a concerted effort to protect your property rights and to protect your privacy by putting that stipulation in there And I've been in contact with someone who's on the State Education Committee A senator from my area

And I think that the gentlemen who wrote the education code and sit on the education committee are totally opposed to this kind of heavy handedness of a program. The state law in this matter is clear if a child is absent three days or parts of days within a four-week period excuse me that might be four days but it's a 4 week period though a four-week period, or ten or more days or parts of days within a six month period the child or parent could possibly be in violation of compulsory attendance laws in this state. If it is found that the child or parent is possibly in violation of compulsory attendance laws The state law outlines specifically what has to take place and that is number one if it seems there might be a violation

2:50:58 the school is supposed to issue a letter sending that letter to the parent saying you might be in violation of compulsory attendance laws, your child might be in violation of compulsory attendance laws. We demand that you comply immediately if the parent or child continues to fail to comply with the law then the state has the ability, law enforcement has the ability to go down and file against you either your municipality, JP court whatever the appropriate authority is to report you then they can get a lawful summons summoning you to a trial pre-trial hearing etc. Then a constable has every right come your home and walk past no trespassing signs in order to serve you a lawful process or they might even be able to obtain a warrant at that point

And that's what I personally have advocated all along. Follow the existing law! That is just not the case The simple fact is the state legislature carefully outlined what is to take place in the event that a child or parent looks like they might be in violation of the compulsory attendance laws. And, the simple fact is the county of Travis is not obeying the Texas State law. They are violating people every night. In fact, they're violating this law upwards of 450 times a night and thats using their own documentation

The program is occurring in areas where people as a general rule haven't voted in years past

Now I made it a point to drive my vehicle up there and drive around the schools those five schools with the most amount in ASAP referrals And i can tell you for a fact...I was the only white person that I saw everyone else I saw was either Hispanic or black It's disturbing me! Or up in North and West Austin. We don't see the program there. Why is that? Because those are areas with people that are affluent,

Now another important point to make We've seen tape now of budget talks where Judge Alshire has come down hard on the statistics surrounding this program. These are issues that I brought forth and Rick Haubecker and others back in the early spring, that these statistics that they have used have been heavily manipulated to put favor upon their program because when you look at the cold hard facts when you look at actual unmanipulated data, you find then in fact the program

This is more indication that this program does absolutely nothing and has no effect on attendance whatsoever The only effect I've seen it has it's draining pockets of taxpayers in Travis County It seems to me and Al Shire points out in this tape in this clip that what we ought to be doing is a comparison of how the schools with a lot of ASAP referrals, how they perform side by side with schools without many ASAP referrals. That will give us a better indication, a much better indication whether or not the program is having an effect

There's something in science called statistical relevance that is if you make the claim the very bold claim that your program has had an effect on attendance You have to prove that! That is you have to come up with some sort of test that will actually prove it was your program that had the effect on attendance. It wasn't something like alignment of planets or
