For those who do, yes send the constable out there if the parent signs on the dotted line It also relinquishes the county of potential lawsuits surrounding this program because there will be lawsuits if it continues 450 visits a night and there's bound to be problems We've seen in the news here recently about one constable that has been accused of raping a young girl I mean this would be a prime opportunity for something like this to take place. How can you do this? Other suggestions of the program, here's what you can do. You can call your county constables. Call them and let them know how you feel. What is even better than that is write them a letter. Write them a letter and say I don't like the way your implementing the ASAP program follow state law or make it voluntary or both

It doesn't need to be county constables coming into your house. pay new school attendance clerks with that money, far less money to come in and make these phone calls. The Criminal Justice Planning Department wrote me back a letter, actually the County Attorney's Office saying Mr. Lane we would like to give you this information however we're not sure that it would be legal to give it to you and maybe a violation of open records law to give you this information so what were gonna do is turn over to the State Attorney General's office let them issue a letter ruling deciding whether or not you can be allowed access to this information

Now this brings us to another very important issue you also heard on the segment with Kevin Miskell, Constable Kevin Miskell he had said leading up to those comments that I pointed out that they attempted to start this program in Lake Travis ISD The program didn't go over very well there. When they first tried this program at Lake Travis ISD, Lake Travis ISD said no way! He said it was a result of the perception of the program that the program was perceived to be exactly as it turns out what is and that is detecting investigating and prosecuting crimes Now the important fact here to note

Definitely there are people who have political influence in Lake Travis ISD In Austin Independent School District however These are areas that have been traditionally politically weak. The program is occurring in areas where people as a general rule haven't voted in years past

A lot of Hispanic individuals, a lot of Afro-American individuals The five schools with the most ASAP referrals are in an area at the intersection of Highway 290 and I35 That is 290 East also right up around the intersection of 183 and I-35, all within about a three mile radius of there. Now I made it a point to drive my vehicle up there and drive around the schools those five schools with the most amount in ASAP referrals And i can tell you for a fact...I was the only white person that I saw everyone else I saw was either Hispanic or black It's disturbing me! It is very disturbing to me that the appearance is there at least

I can show a map, that clearly when you look at it and we'll have it for here in a minute It shows that these schools with the most amount of ASAP referrals are concentrated in minority uh...areas, areas with high populations minorities The areas where we don't see the ASAP program is areas like Westlake Hills, or you have Lake Travis ISD or Round Rock ISD. Or up in North and West Austin. We don't see the program there. Why is that? Because those are areas with people that are affluent,

Now another important point to make We've seen tape now of budget talks where Judge Alshire has come down hard on the statistics surrounding this program. These are issues that I brought forth and Rick Haubecker and others back in the early spring, that these statistics that they have used have been heavily manipulated to put favor upon their program because when you look at the cold hard facts when you look at actual unmanipulated data, you find then in fact the program

Along those lines, we're getting ready to go to that clip in a minute where Judge Alshire has finally come forth and taken issue with many of these statistics Along those lines, we see that... Now along these lines there's an important note to make here the five schools with the most amount of ASAP referrals performed more poorly than the five schools with the least amount of ASAP referrals That is, the five schools that barely had any ASAP referrals between the five school they only had a combined total like 400 visits

This is more indication that this program does absolutely nothing and has no effect on attendance whatsoever The only effect I've seen it has it's draining pockets of taxpayers in Travis County It seems to me and Al Shire points out in this tape in this clip that what we ought to be doing is a comparison of how the schools with a lot of ASAP referrals, how they perform side by side with schools without many ASAP referrals. That will give us a better indication, a much better indication whether or not the program is having an effect

There's something in science called statistical relevance that is if you make the claim the very bold claim that your program has had an effect on attendance You have to prove that! You cannot merely state that look my program went into effect in 1997 And six months later we saw a dramatic increase in attendance.
